How to respond if fired unjustly

If a West Virginia worker has been fired unjustly, it is important to understand the appropriate response. While it is frustrating and overwhelming to be fired unjustly, there are legal options available to those who find themselves in this unfortunate situation. If an employee has been fired for reasons that are illegal, such as racial discrimination or retaliation, this is wrongful termination.

In many cases, employers retain the right to fire an employee at will. For this reason, West Virginia residents may assume that there is nothing that they can do after termination. However, a case evaluation with an attorney knowledgeable in employee rights can reveal if there are concerning factors involved in the firing and determine if a civil claim is an appropriate course of action.

Discrimination based on gender, race or religion is illegal in the workplace. Additionally, an employee is protected from being fired in response to reporting an employer or supervisor for illegal activity. Workers may not be fired for refusing to participate in illegal activity or rejecting unwanted sexual advances/harassment. If any worker suspects that his or her termination is illegal or in violation of company policy, he or she has the right to consider legal recourse against the employer.

Employees have certain rights, even after termination. If you believe that you have been fired unjustly, you may be eligible for financial compensation through a civil claim. The best way to understand your rights in regard to a specific situation is to reach out for assistance as soon as possible after being terminated. Losing your job does not have to mean that you are out of options.
