Wrongful death lawsuit filed against nursing home

A wrongful death lawsuit was filed by the daughter of a woman who fell while a resident at the Trinity Healthcare Services of Logan nursing home. The lawsuit alleges that the former resident was the victim of medical negligence and medical malpractice that eventually led to her death.

The woman fell on March 17, 2015, because the nursing home staff "failed to provide adequate health care, protective and support services to its residents." The lawsuit alleges that the woman suffered multiple fractures in the fall, and also suffered physical pain and suffering, and mental anguish. The lawsuit states that the woman eventually died due to her injuries.

The daughter, representing the estate of her mother, stated in the lawsuit that the nursing home did not provide her mother with adequate care, treatment and supervision. She also alleged that the family was not kept completely informed of her mother's health status.

The lawsuit seeks a jury trial, all monetary and nonmonetary damages, including punitive damages, attorney fees, court costs and any other relief the courts finds just.

West Virginia has one of the largest populations of senior citizens in the United States. As such, the need for nursing home abuse and neglect laws is vital to helping keep our aging loved ones safe. However, this does not always happen and when it doesn't, the outcome is intolerable. Senior and elderly citizens can be subjected to a wide range of abuses, including physical, sexual and mental. They can also be neglected and not receive the care they need.

While not every case of nursing home abuse or neglect results in an injury that can be seen or the loss of a loved one, those who believe their loved one was the victim of such treatment have a right to seek compensation. This can be done through a personal injury lawsuit or a wrongful death lawsuit. An attorney experienced in these types of cases can help you determine how to proceed.
