Texting and driving poses high risk of a car accident

West Virginia drivers may know that texting while driving poses a high risk of a car accident. This behavior is risky and dangerous and one of the leading causes of incidents on the roads and highways. If a car accident is caused by this negligent behavior, it is possible that any victim could consider a personal injury or wrongful death claim.

Texting and driving is an increasing problem for drivers of all age groups. It is estimated that in 2011, over twenty percent of all accidents were caused by a texting driver. These numbers mean that approximately one billion accidents were caused by texting and driving. A large number of drivers, including those in West Virginia, admit to endangering themselves and others by texting while behind the wheel.

Many drivers assume that they have the ability to control the car while texting. This may seem like a harmless and benign action, but there are many examples that tragically prove this assumption to be wrong. Many states have laws that make it illegal to use a cell phone in any capacity while in control of a vehicle. This includes texting or talking on the phone. Despite these laws and the overwhelming proof that texting is dangerous, texting-related accidents still happen every day.

When a person is injured or killed because of the negligent actions of another driver, a personal injury or wrongful death civil suit may be an option. Texting while driving is a negligent action and victims of these types of incidents have every right to pursue needed compensation to cover the costs of their pain and suffering along with their medical bills. It can be difficult to know all of the available legal options after a car accident, but an evaluation of the case details could reveal the best path.
