A former Heritage Care Nursing Home resident alleges negligence

A dementia patient, who had previously resided at Heritage Care Nursing Home, filed a lawsuit against the facility and its owners on Dec. 4, 2017. She alleges that she was treated negligently at their hands during the nearly eight months during 2016 and 2017 that she lived there.

The filing, which is slated to come before a Kanawha Circuit Court judge at a undetermined future date, lists the Huntingon, West Virginia-based Genesis Healthcare LLC, the facility's owner, as one of the defendants. Also listed as a party to the lawsuit are at least 20 other unidentified parties, presumably nursing home employees and administrators.

In the filing, it chronicles how the woman had been taken in to live at the Charleston area skilled nursing home on Aug. 25, 2016. It's at that point that her dementia symptoms had reportedly advanced so much that she could no longer comfortably handle everyday tasks at home.

By April 2, 2017, it's alleged that she'd developed pressure sores. These conditions caused her to develop an infection that caused her significant pain.

The woman alleges that the deterioration in her health was caused by the facility not being adequately staffed to handle the needs of residents living there. This apparently led to staff not providing residents with proper hygiene. It also led to residents not receiving prompt health assessments as well.

The former Heritage Center resident has requested that the case be heard and decided by a jury. She's also seeking an undisclosed amount in damages to compensate her for her pain and suffering. She has also sued for a reimbursement of her legal costs.
